Sheriff: Teen kills mother's abusive boyfriend, won't face charges
A 15-year-old girl grabbed a gun and shot her mom's boyfriend twice, killing him after witnessing her mom being attacked and strangled in front of her.
After responding to a 911 call just after midnight on August 8th, police in a small North Carolina town say they found the Steven Kelley dead in the house, and his girlfriend and her three children still inside. Shortly before that, police say Kelley had been assaulting and strangling Chandra Nierman in front of her 12-year-old, 15-year-old, and 16-year-old. He also was yelling at them threatening to cut their mom's throat and kill everyone in the house.
It was at that point the 12-year-old boy grabbed a gun, but his 15-year-old sister took it from him and then shot twice. Kelley was hit twice in the chest and was killed. One of the bullets fragmented, and ended up also hitting the 16-year-old in the leg.
Investigators say they found Kelley had threatened Nierman several different times. The family had recently moved to the area from Indiana, and police say they found he was a convicted felon with two active domestic violence protection orders from two different women in Indiana and Ohio. Despite being a convicted felon, Kelley kept multiple firearms in the house and police were told he often carried one.
In a statement, police say they referred the case to the District Attorney, and based on all the facts and evidence they decided the shooting was justified and no charges will be filed.
