Man convicted of intoxicated manslaughter sentenced 180 days in jail, 10-year suspension

A Sunland Park, New Mexico man convicted of intoxication manslaughter in the death of Xiaoyan Shi was sentenced to 180 days in jail and a 10-year suspended prison term, meaning he will be under probation for 10 years in addition to his jail time.

The three-day trial ended with a guilty verdict Wednesday evening.

Shi's husband left the courtroom room as soon as the court was dismissed a with a emotionless face.

Anchondo cried twice when he heard his sentence.

“I know there’s going to be a lot of people out in the community that are going to judge this as a slap on the wrist," said Brian Livingston, defense lawyer.

“This is a good young man with no criminal history, a student who works three jobs, a father of a ten year old little girl," said Livingston

Lorenzo Anchondo took the stand Thursday afternoon almost instantly, tears started rolling down his face. The first thing he said was that he was ready to take full responsibility for the death of Shi.

Anchondo recalled the night he got behind the wheel while intoxicated.

“All this time, I felt I was able to drive, but everything happened in seconds,” said Anchondo as he wiped away tears from his face.

Anchondo’s lawyers are asking the jury to consider him for parole due to his clean record. However, prosecutors said he should be considered for up to 20 years in prison.

Prosecutors reminded the jury that Shi was the mother of a 4-year-old girl at the time of her death.

“It’s very difficult, especially for Sofia, losing her mom. I can’t imagine, especially with that. Being that she was so small she was only four and I don’t think she can really comprehend about the concept of death, so all she knows is that mom’s in heaven now. She’s an angel,” said Xiaotao Xu, Shi’s husband.

Anchondo was driving while intoxicated when he crashed into a stop sign that fell on Shi, killing her on Mardi Gras night in 2017.
