Man accused of killing dog after arguing with his mom

A man is accused of killing his mother's dog after throwing it 18-feet across a home during an argument, according to court records.

James Garcia, 39, has lived with his mother on and off for four years, according to the affidavit. Police said he and a female friend were arguing with his mother Oct. 24, his mother said she didn't want him living there anymore because of his drug use history.

During the argument, Garcia allegedly picked up her small dog, "Roxy," and threw her 18-feet across the home, she landed in the kitchen on the hard floor. Police said Gracia left the home, leaving his mother with the dying dog.

A neighbor helped out his mother by taking Roxy to the vet, but the vet pronounced her dead at the hospital, saying Roxy died of a burst heart, which led to her bleeding to death.

Police arrived to the home later and so did Garcia, along with the female friend. Garcia said he had come back to pick up some of his things and "he didn't like hurting the dog," according to the affidavit. However, he said the dog "got in his way and barked loudly," he also allegedly told police his mom should allow him to bring women home, because he lives there.

Garcia was arrested Saturday.
