Rape suspect stabbed by victim’s father, both men now facing charges
WEST PALM BEACH, Fla. (WPEC) - The father of a teenage rape victim is facing charges after he allegedly stabbed his daughter’s accused rapist with a box cutter.
Roberto Rubio, 26, of West Palm Beach, is being held without bond at the Palm Beach County Jail. He is charged with three counts of sexual assault on a victim between the age of 12 and 17.
CBS12 is not disclosing the name of the victim’s father in an effort to protect the victim’s identity. Court records show the father is being charged with aggravated assault.
Palm Beach County sheriff’s investigators say on Monday the 13-year-old girl told her mother that she had been sexually assaulted on three separate occasions by a man known on the streets as “Salvador.” Deputies say “Salvador” is Rubio.
The victim’s mother immediately called 911 and then her husband, who reportedly drove home from work.
While deputies were on the scene, they were told the victim’s father and brother had tracked down Rubio hiding out in a nearby car. There was a struggle that led to the suspect being stabbed.
“[The father] states he found Salvador hiding inside of his car, and when he confronted him, Salvador tried to run away,” the father’s arrest report states. “[The father] states while struggling they both ended up in a canal which was located behind the trailer. He does not know where the box cutter is and believes it might have fallen into the canal. Both men were wet and muddy when I first observed them. [The father] denies intentionally stabbing Salvador with his box cutter and states he only confronted him to bring him to law enforcement.”
Deputies say while this was happening, they were at the family’s home.
“I observed two white males walking towards my car on 63rd Way South. One male, later identified as [the father], was holding on to the back of the neck of the other male and was forcing him to walk towards me. The other male, I later learned was Salvador. I made contact with Salvador to take him into custody and saw he had a bloody nose and blood pooling on his clothing around his lower abdomen area.”
Rubio was taken to St. Mary’s Medical Center and later released. He was then taken to Palm Beach County Jail. He remains there without bond.
Investigators say Rubio admitted to having sexual relations with the teenager but says it was consensual.
“Roberto said on several occasions he entered [the victim’s] bedroom through her window to have sex with her,” Rubio’s arrest report states. “He denied forcing her to have sex with him and states [the victim] was the one who always initiated sex.”
While Rubio is being held without bond, the victim’s father has been released on a $10,000 bond on charges of aggravated assault. He’s also been ordered to have no contact with the suspect and is prohibited from possessing any weapons.
