Police charge babysitter with killing 11-month-old child
SAN ANTONIO - Police have charged a 23-year-old man with killing an 11-month-old child he was babysitting last Friday.
The child was being cared for at a home on North San Ignacio when he reportedly stopped breathing. According to court papers, Miguel Gutierrez was caring for the child and alerted a family member who called 911.
When paramedics arrived, they noticed bruising on the child's abdomen. They, in turn, alerted police officers who arrived after Gutierrez left the house.
The 11-month-old boy, identified in court papers as Xzavier Cortez, later died at the Children's Hospital of San Antonio. The Bexar County Medical Examiner's Office ruled Xzavier's death was caused by non-accidental blunt force trauma.
When police questioned Gutierrez, he admitted he was the only adult caring for the baby and three siblings, but denied causing the child's injuries. The child's mother told investigators she left her children in the care of Gutierrez when she went to work and added he is only a friend and not the father to any of her children.
Gutierrez is now charged with capital murder.
