Comal County man convicted for sexual assault of 12-year old girl

NEW BRAUNFELS -- A Comal County man could spend the rest of his life in prison after investigators say he sexually assaulted a 12-year old girl while riding home on a school bus.

Prosecutors say the defedent was a senior at Canyon High School, but also considered an adult at the time of the assault.

Court records show the assault happened on February 14, 2014.

Fredys Rios-Barahona was 17 at the time.

He and the 12-year old victim attended separate schools, but rode the same bus home each evening.

On the ride home from school, investigators say the senior at canyon high used his fingers to sexually assault the 12-year old.

A couple months later, the young girl eventually told her mother what happened.

“She was brave enough to come into this courtroom and testify as to what took place," said Comal County district attorney Jennifer Tharp.

Barahona pleaded not guilty to both charges.

Detectives from the New Braunfels Police Department went dug into Barahona's past.

“Going through the school records they did see a pattern of inappropriate behavior by the perpetrator with other students,” said Tharp.

The information is something Tharp says prosecutors will plan to present to the judge during the punishment phase.

Barahona faces anywhere from 5 to 99 years or life in prison.

The district attorney's office says the punishment phase is scheduled to start in late June.
